Scope of Application

These General Terms and Conditions of Sale are intended to govern the relationship between TIBAN GANG®, located at 4 vallée de la Grippère 97170 Petit-Bourg FRANCE, and any customer of the website tiban-gang.tpopsite.com. Placing an order implies the customer’s full acceptance of these General Terms and Conditions of Sale. TIBAN GANG® reserves the right to modify these General Terms and Conditions of Sale at any time without prior notice.

Product Information

Product Characteristics

  We take the utmost care in preparing the visuals as well as providing the most complete product descriptions for the items we offer. However, the descriptions and visuals are not contractual. Many factors influence the visual rendering of products (color settings, your computer hardware settings, supplier images, etc.). If you find that one of the displayed items does not meet your expectations or differs from what you received, please feel free to contact us via email ([email protected]) or through the Contact page. After verification, we will make the necessary corrections.

  The trademarks and groups mentioned on the website https://tiban-gang.tpopsite.com/ are registered and protected by their respective owners.  

Prix des Produits

The prices of the items listed on the site are expressed in Euros (€), USD, CNY, GBP, CHF or JPY and include shipping fees. As TIBAN GANG® is not subject to VAT, the prices are exclusive of tax (HT).

TIBAN GANG® reserves the right to modify its prices at any time without prior notice. However, the applicable prices are those in effect on the day the order is placed.

Online Payment Methods

To pay for your order in full:

We accept all types of credit cards (Carte Bleue, Visa, Mastercard, etc.) that allow for remote payments through Link, a secure payment service provided by Stripe.

The customer securely provides their credit card type, number (16 digits), expiration date, and security code (the last 3 digits on the back of the card).

Shipping fees are included in the price displayed online.

Packaging

In an effort to respect the environment as much as possible, the items are shipped in cardboard envelope pouches or boxes, depending on their size and fragility.

Packaging costs are covered by TIBAN GANG®.

Delivery

Delivery Method

Delivery is made to the address provided by the customer at the time of ordering. It will be carried out by La Poste. Regardless of the delivery location, La Poste will hand over the package to the national operator of the destination country: this ensures that the package will be delivered to your mailbox.

Worldwide Shipping

We deliver almost everywhere!

Only a few destinations are not deliverable (due to government restrictions or shipping impossibilities): Afghanistan, Cuba, Crimea, Iran, Libya, Sudan, Syria, and North Korea.

Additionally, frequent shipping difficulties have led us to remove the following destinations from the list of possible shipping countries:

Saudi Arabia, Egypt, and the United Arab Emirates.

Delivery Times

Delivery times are provided as an estimate and refer to business days. They are average times and may vary depending on the destination.

In general, your order will be shipped within 24 to 72 hours from the day after it has been placed, except in cases of payment failure, reservation, or unexpected stock shortages. In the event of a sudden increase in activity, bad weather, or any other unforeseen circumstances, the preparation time may be extended. If a problem arises during the preparation and shipment process (stock shortage, incomplete address, payment rejection, etc.), our team will contact you as soon as possible.

For example, the delivery time for mainland France is on average 3-4 days from the time La Poste takes charge of the package. For Guadeloupe, it is 7-8 days from the time La Poste takes charge of the package.

In case of an address error or incomplete address, neither TIBAN GANG® nor the carrier will be held responsible. If an address error leads to the return of the package, the re-shipment costs will be borne by you.

Tracking and Receiving the Package

  Any package received in error must be returned to us. If this happens, please contact us by phone or email at [email protected], so we can send you a prepaid return label, allowing you to return the package at no cost. Do not return the package at your own expense, via cash on delivery, or with postage due.  

Once your order is validated, a tracking number will be assigned to it. You can then follow its progress until it reaches your mailbox.

If you notice suspicious damage to the package upon receipt, please take a photo of the damage before opening it, then another after opening to verify the product’s integrity. If the product is damaged, contact us within 48 hours at the latest, otherwise, we will not be able to replace your order.

Delivery Delay

Shipping is provided by third-party service providers, and no compensation will be granted by TIBAN GANG® in case of a delivery delay.

In the case of a delay on a tracked package, an investigation will be requested from the carrier.

  If you haven’t provided your phone number or email address and your order has not arrived within ten (10) days for Metropolitan France or fifteen (15) days for other territories (DOM-TOM and others), feel free to contact us by email at [email protected] or via the Contact page.  

"Delivered" Package Not Received

In many cases, the package may have been left with a neighbor, or you may not have a standardized mailbox.

If the mailbox is not standardized, or the package cannot be placed inside (because it contains too many products), it is possible that the postman/delivery person left it at the post office.

In this case, the recipient must go to the nearest post office with the tracking number and an ID to collect the order

The carrier’s tracking system is binding: if the package is marked as “delivered,” no further action can be taken.

Order Modification or Cancellation

It is possible to modify an order’s details within 24 hours of placing it.

  If you wish to cancel or modify the contents of an order, change the delivery address, or add additional items, you must contact us as soon as possible by sending an email to [email protected] or through the Contact page. However, the processing of these requests is not instantaneous, and TIBAN GANG® does not guarantee that the changes will be applied in time.  

You have a period of fourteen (14) business days to return unwanted items or request a product exchange.

Right of Withdrawal and Order Return

You may return an item(s) that does not suit you for an exchange, credit note, or refund.

You have the right to withdraw from this contract without providing any reason within fourteen (14) days. The withdrawal period expires fourteen (14) days after the day you, or a third party other than the carrier and designated by you, takes physical possession of the last item. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by an unambiguous statement (e.g., letter sent by post or email).

You can also use the withdrawal form template below, but this is not mandatory.

For the withdrawal period to be respected, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effect of Withdrawal

In case you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for any additional customs fees) without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract.

We will proceed with the reimbursement using the same payment method that you used for the initial transaction, and in any event, this reimbursement will not incur any fees for you. We may withhold reimbursement until we have received the goods back.

without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract. The deadline is met if you return the goods before the period of fourteen days has expired.

You must bear the cost of returning the goods.

However, there is no issue with returning a discounted or on-sale item.

Return Terms

You are asked to return the items in the condition in which you received them. Please return them in their original packaging, unworn, unwashed, and complete (i.e., with their product tag and any accompanying accessories).

To make this process as cost-effective as possible for you, we advise you to return your order by reusing the parcel we sent to you or any other valid packaging (except for prepaid Post Office parcels due to their cost) and opt for a tracked Colissimo shipment without signature.

ATTENTION: We will not accept any return by Cash on Delivery or postage due.

Don't forget to include the return form attached to your parcel or a photocopy of your invoice, to remind us of your details and summarize your request.

The refund for an order is made via the same payment method:

- By bank check, sent by mail as soon as possible and no later than fifteen (15) days

- By bank transfer, please include your RIB (Bank Identity Statement), which means your complete IBAN (Bank account number + the name and address of your bank)

Return of an item due to a defect or preparation error

  If you find an error in your order or receive a damaged or defective item, please contact us as soon as possible by email at [email protected] or via the Contact page. A reservation for a new item can then be made immediately  

The shipping costs incurred for returning your order will be covered by TIBAN GANG®. However, we will not accept any return by Cash on Delivery or postage due: a prepaid Colissimo return label will be provided to you (via email or by mail at your convenience) after review and validation by our services.

You will only need to reuse the package you received or recycle any packaging you have on hand to attach the return label.

The exchange will of course be carried out at no cost to you (via Tracked Colissimo, So Colissimo, or Tracked Letter) upon receipt of your package, unless you prefer a refund. You can indicate your preference in your email as well as in the letter enclosed with your package, reminding us of your details and the issue encountered

Protection of Minors

In the case of an order placed by a minor, it must be made in the name of the Parents, Guardian, or Legal Representative with their consent.

In case of dispute or false information provided by a minor, the legal representatives will always be held responsible.

Retention of Ownership and Responsibilities

The products remain the property of TIBAN GANG® until full payment of the total order amount.

TIBAN GANG® cannot be held liable for non-performance of the contract due to a stock shortage or product unavailability, in the event of a total or partial strike by shipping services, force majeure, or natural disasters.

Intellectual Property on Creations

  All creations (graphic charter, content, images, typography...) are the exclusive property of TIBAN GANG®. They may not, under any circumstances, be distributed on other platforms besides the website https://tiban-gang.tpopsite.com.  

Data Confidentiality

The personal data provided by the customer will not be shared with third parties under any circumstances.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and oppose all of your personal data at any time by writing to us by mail and providing proof of your identity at the following address:

Disputes and Applicable Law

TIBAN GANG® reserves the right to cancel any order from a customer with whom there is a prior dispute.

Anti-Fraud Policy

In case of fraudulent use of a credit card or payment default, your information will be forwarded to the Pointe à Pitre Public Prosecutor's Office (971) for investigation

To combat payment fraud, we reserve the right to:

- Block orders paid by bank transfer for seven (7) days after payment is received;

- Conduct random, systematic, or targeted checks on the data provided;

- Contact customers directly for verification and order confirmation;

- Require supporting documents (ID, proof of address, etc.) to unblock orders; ;

- Request an alternative payment method;

- Use service providers for checks and data analysis.

Jurisdiction Clause

These conditions are complete and final. Sales conducted by Contre Propagande are governed exclusively by French law. The contractual information is presented in French, and the products offered for sale comply with French regulations. Contre Propagande cannot be held responsible for non-compliance with the legislation of the foreign country where the customer resides. In case of a dispute, only French courts will have jurisdiction.
